CBG Funds

Terms of Service

Last updated 21 October 2026

These terms apply when you use the CBG Funds website or the KLIERD platform. "We" and "us" mean Cole Benefit Group INC, doing business as CBG Funds. KLIERD is the funding platform we operate. By using the site, submitting an application or signing in to a portal, you agree to these terms.

Read this first

These terms cover the website and the platform. They are not your funding agreement. If we go forward together, you will receive and sign a separate written agreement that sets out the actual terms of your funding — the amount, the fee, the security taken, and the obligations on both sides. That signed agreement governs the funding itself, and where it differs from anything here, it wins.

We are not a lender. We do not make loans or commit anyone else's money. We help you prepare and present a funding request to lenders, and we are paid a fee for that work.

1. What we do

CBG Funds is a funding consultancy. We work with business owners seeking a business HELOC and related funding. Our work typically includes:

What we do not do

2. No guarantee of funding

Nothing on this website, in any flyer, in any conversation with our staff, or in any figure shown to you before an offer is made, is a commitment to fund you or an offer of credit. Estimates are estimates. Approval, the amount, and the terms rest with the lender and depend on your credit, income, business and property as the lender assesses them. Results vary from one client to another and past results do not predict yours.

3. Fees

We are paid a consulting service fee for the work described above. The rate is agreed with you in writing per deal and is set out in your signed agreement before any obligation to pay arises. You receive one invoice from us for the total.

Where another party referred you to us, any fee we pay that party is our cost, paid out of what you have paid us. It is not an additional charge to you.

Our fee is for our work and is separate from anything a lender charges you.

4. Your responsibilities

5. Your portal account

We may suspend or close an account that is being used to break these terms, to commit fraud, or in a way that threatens the security of the platform or another client's information. Where we reasonably can, we will tell you why.

We aim to keep the platform available but cannot promise it will be uninterrupted. It depends in part on services we do not control.

6. Communications and text messages

By giving us your contact details you agree that we may contact you about your file by email, telephone and text message. Service messages — sign-in codes, status updates and document requests — relate to a file you asked us to open.

Marketing text messages require a separate, optional agreement that is never ticked for you. Declining it has no effect on your application.

Message frequency varies and message and data rates may apply. Reply STOP to end messages or HELP for help. Full detail is in our Privacy Policy.

Email is not a secure channel. Please upload sensitive documents through your portal rather than attaching them to an email.

7. Electronic signatures and records

You agree that documents signed electronically through our e-signature provider are binding, and that we may give you agreements, notices and disclosures electronically. You may ask for a paper copy at any time. You will need a device, a browser and an email account to receive electronic records.

8. Privacy

How we handle your information is set out in our Privacy Policy, which forms part of these terms.

9. Our content

The website, the KLIERD platform, and our text, design and materials belong to us or our licensors. You may use them to deal with us and for no other purpose. Please do not copy, resell or reverse-engineer any part of the platform.

10. Third-party services

We rely on third parties for identity verification, e-signature, email and text delivery, payments and hosting. Their own terms govern their services. We are not responsible for a third party's acts or omissions, though we choose our providers with care.

11. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential loss, or for lost profits or lost opportunity, arising from your use of the website or the platform. Our total liability arising out of or relating to these terms will not exceed the fees you have paid us in the twelve months before the claim.

Nothing in these terms limits any liability that cannot be limited by law, and nothing here affects your rights under your signed funding agreement.

12. Indemnity

You agree to cover us against claims, losses and reasonable legal costs arising from information you gave us that was false or misleading, or from your breach of these terms.

13. Disputes

These terms are governed by the laws of the State of Georgia, where Cole Benefit Group INC is registered, without regard to its conflict-of-law rules. We work with clients across the United States; choosing Georgia law here does not remove any right you have under the law of your own state that cannot be waived by agreement.

Before starting any formal proceeding, please contact us at info@cbgfunds.com so we can try to resolve the matter directly. Most complaints are settled this way.

14. Changes to these terms

We may update these terms. The date at the top shows when they last changed. If a change is material we will tell you. Continuing to use the site or the platform after a change means you accept the updated terms.

15. General

If any part of these terms is found unenforceable, the rest continues to apply. Our not enforcing a term on one occasion does not waive it. You may not transfer your rights under these terms without our written agreement.
